The logical beginning of any estate plan is the creation of a will. In a nutshell a will is your directive as to the distribution of your assets upon your death. A will only becomes effective upon your death and may be changed at anytime while you are still alive.

Intestate vs. Testate
When you die without a will your property will be distributed in accordance with Ohio’s intestate statute. As a result, the person receiving your assets upon your death will be determined by state law and not you. Conversely, having a valid will allows you significant say in choosing the fiduciary (the person that will administer your estate) and your property will be given to those individuals or organizations that you choose. You will also be able to appoint the guardian of your minor children, instead of giving up any choice in the matter to the probate court.

Additionally, having a valid will relieves your loved ones of the added stress and expenses of a lengthy probate court proceeding and increased administrative costs. Every will is unique to the individual and tailored to meet your specific needs. During my representation I take the time to understand and advise you. Decisions regarding whom and what to leave someone are difficult and need to be planned out to avoid unintended consequences.
