Mediation Overview

Mediation is a voluntary process that brings people together to discuss complex or minor problems in front of a mediator. It is an alternative to litigation at the Courthouse. It can be much cheaper to mediate your issue than to litigate it, as hiring two attorneys or more and having Court expenses, is much more expensive than hiring one mediator.

A mediator is a third party neutral, who guides the mediation process and aids the parties in discussing issues and, hopefully, coming to an agreement. A mediator does not provide any legal advice or make any decisions in the matter.

Mediations can be extremely effective in giving all parties an opportunity to be heard. The mediator also aids in making sure that all parties are informed and making any commitments voluntarily. Any party can disagree with any provision of a potential agreement at any time. A party can also seek legal counsel at any time, if he or she so chooses.

Communications made during mediation are generally confidential, except for a few minor exceptions, whereas, hearings at the Courthouse during litigation are very public, with other attorneys, court personnel, and other parties present in the Courtroom.

Any party can discontinue his or her participation in mediation at any time, if he or she should decide that it is no longer appropriate. However, a successful mediation requires the parties to commit to a meaningful process of communicating and addressing what can be very emotional issues or difficult matters.
